Terms & Conditions

These terms set out the basis on which Cellar Key Ltd sells wine and spirits to you. Please read them carefully. By placing an order with us, you agree to these terms. If anything here is unclear, please ask us before you order.

1. Who we are

Cellar Key Ltd is a company registered in England and Wales (company number 12452481), with its registered office at South Lodge, Kidbrooke Park, Forest Row, East Sussex, RH18 5LG. In these terms, "we", "us" and "our" mean Cellar Key Ltd, and "you" means the person placing the order.

2. Placing an order

When you place an order, whether online, by email or by telephone, you are making an offer to buy. Because much of our stock is rare and held in bond, we confirm availability before anything is final. A binding contract is formed only when we confirm your order and the arrangements for payment and delivery. If, for any reason, we cannot fulfil an order, we will tell you promptly and arrange a full refund of anything already paid.

3. Prices

Unless stated otherwise, prices shown are in pounds sterling (GBP), per unit, in bond, meaning UK excise duty and VAT are not yet included. Where the site displays a price in another currency, that figure is for guidance only; all sales are settled in GBP. Duty, VAT and delivery are additional and are shown at checkout or quoted to you before you commit, depending on how you choose to receive your wine (see "Delivery and storage" below). We take care to price accurately, but if a genuine error comes to light we will contact you before proceeding, and you may confirm the corrected price or cancel.

4. Payment and title

We accept payment by bank transfer and, where offered, by debit or credit card. For higher-value wines we may raise an invoice and confirm the final total, including any duty, VAT and delivery, before payment. Ownership of the wine passes to you only when we have received payment in full and funds have cleared. Risk in the wine passes to you on delivery, or, where wine remains in bond in your name, when it is transferred to your account.

5. Delivery and storage

You choose how your wine is handled. Full details are on our Delivery page. In summary:

  • In bond. Your wine remains in professional bonded storage at Octavian, Corsham, with duty and VAT unpaid, ideal for cellaring or resale. We can arrange transfer into your own bond account where applicable.
  • Duty paid (UK). We release your wine from bond, pay UK excise duty and VAT, and deliver to your door. Duty is calculated per litre of pure alcohol at current HMRC rates and shown clearly before payment.
  • Overseas. We ship worldwide through trusted agents. As carriage depends on destination and volume, we quote shipping separately once we have your order.

We offer free UK delivery or bonded transfer on orders over £1,000 (excluding tax); below that a flat delivery charge applies. Delivery times vary with the option chosen, the wine's location and prevailing conditions; we confirm timings with you on every order and will always be candid about what is achievable.

6. Cancellation and returns

If you are a consumer buying at a distance, you have a legal right to cancel within 14 days of receiving your wine, subject to the exceptions below. To cancel, simply contact us. Where wine is returned, it must be unopened and in its original condition; we will refund the price once we have received it back, and may reduce the refund to reflect any handling that goes beyond examining the wine. The right to cancel does not apply to wine that has been opened or is no longer in a resaleable condition, nor to wine supplied to business customers. This does not affect your statutory rights.

7. Faulty or damaged wine

We stand behind every bottle we sell. If a wine reaches you damaged, or you believe it to be faulty, please tell us as soon as you reasonably can and keep the bottle and, where possible, its contents. We will put matters right by replacement, refund or other fair remedy. Fine and mature wine is a natural product, and we offer honest guidance on provenance, condition and drinking windows in good faith; that guidance is an opinion, not a guarantee of how a given bottle will show.

8. Overseas orders, duties and taxes

For wine shipped outside the UK, any import duties, taxes and customs charges levied at the destination are your responsibility and are not included in our prices unless we have agreed otherwise in writing. You are responsible for ensuring that you may lawfully import the wine into your country.

9. Age restriction

It is against the law to sell alcohol to anyone under the age of 18. By ordering, you confirm that you are at least 18 years old, and that any person receiving a delivery on your behalf is also at least 18. We may ask for proof of age on delivery and may refuse or cancel a sale where we are not satisfied.

10. Our liability

We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to that, our total liability to you for any order is limited to the price paid for that order, and we are not liable for losses that were not reasonably foreseeable at the time the contract was formed.

11. Your information

We handle your personal information in line with our Privacy Policy. We use it only to process your order, provide our services and, where you have asked us to, to let you know about new arrivals and offers.

12. Governing law

These terms, and any dispute arising from them or from an order, are governed by the law of England and Wales, and are subject to the non-exclusive jurisdiction of the courts of England and Wales.
